Proposed Variation to the County Donegal Development Plan 2018-2024 (As Varied) in respect of the deletion of Letterkenny-specific policy content
Whereas statutory planning policy for Letterkenny is currently contained in the County Donegal Development Plan, 2018-2024 (As Varied) (‘the CDP’), on 13th November, 2023 Donegal County Council adopted a new Letterkenny Plan and Local Transport Plan 2023-2029. The new Plan will come into effect on 3rd January, 2024. As the CDP will remain effective until July 2024, there would be two statutory land use plans in place at the same time for Letterkenny for a period of approximately six months in the absence of the adoption of the proposed Variation. Furthermore, the contemporary Local Area Plan would, by law, be subservient to the older CDP. To regularise this situation, Donegal County Council is proposing to remove the Letterkenny-specific content from the CDP by means of a statutory Variation in accordance with the provisions of Section 13 of the Planning and Development Act, 2000 (As Amended). Of note is that the proposed Variation will not introduce any new policy.
The Council has also prepared the following associated reports:
An Appropriate Assessment Screening of the Proposed Variation in accordance with the requirements of Article 6(3) of the EU Habitats Directive (92/443/EEC) and Part XAB of the above-noted Act; and
A Strategic Environmental Assessment Screening of the Proposed Variation in accordance with the requirements of Article 13K of the Planning and Development Regulations, 2001 (As Amended).
